By your reservation you are deemed to have understood and accepted all the terms and conditions of this agreement.All prices in USD and HI State Tax of 11.42% will be added.
  1. In order to maintain a high standard for the condo and optimal enjoyment for all guests, please respect the property as your own.  Absolutely no smoking anywhere in the condo, including the lanai.  In the event of smoking, there will be a minimum charge of $300 for a complete cleaning of the unit plus other damages. No pets allowed any time.
  2. The maximum number of guests is two (2).  Unauthorized additional guests will be charged at $60 per guest per day.  Check in at 4 pm or later on the day of the arrival and check out by 11 am the morning of departure.  Any late departure will be subjected to a triple daily rate charge in order to accommodate the next guest.  Early check-in is possible based on availability but must be previously arranged.
  3. Deposit and payment are accepted in the form of wire transfer, money order, credit cards through Paypal.  A deposit of 30% of your stay will confirm your reservation.  Payment in full and the full damage deposit ($400) must be received 40 days prior to arrival otherwise the reservation is deemed cancelled by you.  All reservations within 40 days of arrival will require full payment and damage deposit.  Cancellations 60 days or more prior to arrival will receive a refund of the deposit less $100 cancellation fee.  Cancellation made less than 60 days but at least 40 days prior to arrival, you will forfeit the deposit amount.  Cancellation within 40 days will receive refund of damage deposit only.   Reservations made less than 40 days will require the full payment plus damage deposit in order to confirm the booking.  Change of dates 60 days prior to arrival will be accommodated as long as the unit is available.  You are responsible for the difference in the rates.  Payments are non-refundable unless otherwise stated.  All cancellations must be received in writing, fax or via email.  The cancellation date is determined by the date that your written cancellation is received by us.  A pre-authorization (will be emailed or faxed to you) for VISA must be signed by you to cover damages beyond $400.  If there were no damage or additional charges, the $400 security deposit  will be mailed to you within 6 weeks of your departure.  We will attempt to notify you of any additional charges shortly after your departure.
  4. It is agreed that you are responsible for any damages during the rental period.  The damage costs include but not limited to labor, replacement, and loss of use/income.  Cleaning charges do not include dirty dishes.  Please leave the kitchen as you have found it.  If the property is left in an excessively dirty state, additional cleaning charges will apply based on the additional costs for cleaning.
  5. You must leave all original keys and parking tag upon departure.  Any key loss will be subjected to the cost of an emergency locksmith visit to change the lock and duplicate all the keys. You must leave the original parking tag in good condition upon departure for the next guest.  Failure to do so will result in a minimum $100 charge for emergency replacement.
  6. Please keep noise to a minimum between the hours of 10 PM and 8 AM.  It is agreed that you will treat the property, its contents with all due care and respect.  As with local Hawaiian tradition, shoes are to be removed after entering the front door.  Surfboards, body boards or other beach equipment are not allowed in the condo.  Sand in the condo will be assessed damage costs.  Please shower and clean off sunblock from the body prior to coming in contact with furniture in order to avoid damage charges.
  7. We reserve the right to cancel the reservation without compensation or liability in the event that the unit becomes unavailable due to reasons beyond our control.  The reasons include but not limited to: 1. Unforeseen circumstances such as natural or man-made disasters that renders the unit unsuitable for habitation.  2. Damage by previous guests.  3. Major breakdown of equipment or appliances within the unit.  4. Sale of the property with a closing date before your reservation.  5. Force Majeure. Force Majeure literally means "greater force". These clauses excuse us from liability if some unforeseen event beyond our control prevents us from performing our obligations under the contract. Typically, force majeure clauses cover natural disasters or other "Acts of God", war, or the failure of third parties--such as suppliers and subcontractors--to perform their obligations to us.  We will attempt to accommodate you somewhere else.  Our liability is limited to amount of your payment and depended on the number of days that we were not able to accommodate you.
  8. We cannot accept responsibility or liability for any accident, injury or illness, stolen, loss or damage of you or your personal property during your stay, regardless of the reason.  Please contact the appropriate authorities through dialing 911.  The use of any other common facilities including but not limited to pool, spa and other common areas are deemed to be use at your own risks.
  9. In the event of deficiencies or failure of equipment please notify us immediately.  We will attempt to remedy the problem.  You agree to allow repair or maintenance staff full access to the unit in order to remedy the problem.
  10. In the event that we believe you have supplied incorrect or untrue identification information, the reservation will be cancelled at the your cost as above.
  11. You hereby agree to pay additional damages or charges as determined above to your VISA account.  In the event of additional cost beyond the damage deposit, you hereby authorize us to charge your VISA account for the full amount.
